RATES, TERMS OF BUSINESS AND OUR COMMITMENT FOR THE INTRODUCTION OF STAFF
- Definitions: These Terms and Conditions of Business are between prime people (hereinafter referred to “We”, “Us”, "Our") and [Customer] (hereinafter referred to "You", "Your"). The engagement by You of an applicant for employment introduced by Us shall constitute an acceptance by You of the conditions described hereunder.
- Quality control: We will work closely with the hiring manager to represent You and the role accurately and positively. Every candidate that comes into contact with You will be asked to look into what You do, clients and history and to ensure that only those candidates that have a genuine interest in Your sector and subject matter are motivated to have a conversation with You.
- Communication: We will work in the best interests of You to find suitable candidates at fair market salary rates. At its discretion, You may elect to speak or communicate directly with the candidate to negotiate or discuss the role. We will provide contact details and facilitate direct communication. Any information marked confidential will not be shared with candidates or any other third party without explicit permission by You.
- Suitability: Whilst every reasonable effort will be made by Us to ensure the suitability of applicants selected on behalf of You, it is You who is responsible for establishing the final suitability of applicants, for taking up references concerning the applicant's skills, qualifications and general integrity, obtaining work permits, medical requirements and checking applicants' qualifications as required by You or applicable law.
- Responsibility: We cannot accept responsibility for any loss, expenses, damage or delay however occasioned in respect of any applicant, We are engaged as a consultant adviser to You. You has power of final decision and veto in respect of any application.
- Confidentiality: Introductions are confidential. Where You, employees, associates or representatives of You refer an applicant to any other persons or organisations, then an introduction fee is deemed payable by You as if You had engaged the applicant.
- Notification: You agree to notify Us immediately a candidate introduced by Us is offered a position with You within 6 months from the date of initial engagement, with details about the offer.
- Duplicate applications: Simply evidence an interaction with the candidate about the role which happened prior to the introduction by US.
- Fee: The fee is payable to Us by You on commencement of a candidate within 30 days of Our invoice, calculated at a rate of 20% of salary before any bonuses or incentives, plus VAT at the applicable rate.
- Rebate: If the candidate leaves Your employment within 3 months of commencement, You will notify Us immediately and, providing timely payment of the account has been made, and the candidate is leaving for reasons beyond the control of Us, You, at its sole discretion, is entitled to a free replacement or a full refund, which will be paid within 30 days of the departure date.
- Non solicitation: You will not approach anyone you have placed (Or our staff) within our business for a period of 2 years or 12 months from date of last invoice whichever is sooner
- Retained work: Fees and costs for executive search assignments will be detailed in a separate assignment proposal following a full briefing between Us and You. All other terms detailed here will apply to retained work unless excluded or varied in the assignment proposal.
